    I just found the answer to what is wrong in America

    I would like to meet the person with the total lack of dignity that would attempt this fiasco! Is she hoping for an out of court settlement? Buickguy, any input on this one?

    I want to hire that lawyer! I just found out that Burger King may be serving cholesterol! How dare they do that to poor, unsuspecting heart patients like me - never mind our defenseless children.

    Seriously, what ever happened to personal responsibility? I think it's great that food companies were required to post the contents and nutritional information on the box, but it has to be our responsibility to READ them. It'll be interesting to see where this goes. I'm thinking of the lady who sued McDonalds and won because her coffee was hot and she spilled it on her lap. Unless she ordered iced coffee, I'd have told her to shove off if I'd been the judge.

    Dan - the coffee thing in Texas, this little fact rarely hits the newsreel but perhaps you'd like to take a crack at answering it. The coffee was 130 degrees, didn't have any kind of coffee cozy around it, and was handed to this lady through the drive-through window who had no where to put it except between her legs... she had 2nd degree burns on her lap... so the question, what reason could there possibly be to have coffee handed out to the unsuspecting public? I get personal responsibility - however, last time I checked assault is still a crime. (and that is the cause of action, under which she sued and won).

    The grounds in the Crunchberry suit is pretty simple - truth in advertising, if it says berries; Pepsi should probably have berries in their cereal.... okay, nothing groundbreaking, but here's why you care - this is another lawsuit being politicized. There is a wave of petitions going throughout the States that demands that restaurants, food manufacturers and the like put a list out stating what is in their products; along with a nutritional guide. This arose because of the same group of marketing genuis' (who were fired from MacDonalds - bet you wondered how that worked in) who thought that truth in advertising was some kind of slippery slope and as along as people assert something is in there; that no one would hold them accountable.... of course the manufacturers have a problem with this.... mostly because FDA requirements (for example) state that you can have x number of rodent hairs in your snickers, x number of turds... etc without being listed as an ingredient..... it really is enough to put anyone off their lunch if the true information was disclosed. (you really didn't think the farmers, food manufacturers, or restaurants could keep all the rats (slugs, snails, stray cat) out of the food supply, did you?)


    Up to this point, the food industry has done an admirable job of lobbying to prevent food safety laws from happening on the national level. So, they go state by state - a divide and conquer mentality, if you will. Next up, California... so watch the wave of publicity on these lawsuits.... the petition is soon to follow or this is lead in for a ballot measure that will hit in November.
    so anyone who is in the food industry does not want these laws to take effect.
    Maybe I'm just to cynical.... naw.

    I don't buy the McDonald's lady's lawsuit. She knew (or should have known) that she had no place to put a cup of hot coffee before she got in the drive thru line. If the employee had poured it on her it would have been assault, but I never heard that argued. I think it was a soft-headed jury.

    Granted, the trace ingredients are not listed on the box, but the major ingredients - like, for example, berries - are. The idiot failed to read the box, long and short of it. I'm a diabetic heart patient - I read the info on EVERYTHING I put in my face, if available. I'll go on line and read what's in restaurant food before I go there, if possible. Sometimes the info is not available and I make an educated gamble - and I know it's a gamble. My choice, and no one's fault but my own if I'm wrong. Check my blood glucose meter history and you can see when I missed it - no lawsuits coming from me. PERSONAL RESPONSIBILITY!

    I have NO sympathy for this lady - she's an idiot. I suppose she'll bring suit against the candy companies when she finds that there in no turtle in her turtle candies. I guess they won't choose me for her jury.

    I am alot native American and I say to the victor go the spoils. one tribe didnt have an issue with killing another tribe and taking their land. massacres and whatnot between tribes. this time the better tribe won.

    everyone hates on Europeans for winning, having technology, and being the better "tribe". dont hate the player. hate the game, ya know? i mean china and japan had guns and swords and arrows while living in houses. Europeans had arrows swords and guns and houses. all the lesser tribes of the world lived (and some still live) in dirt and have a stick.
    probably not "fair" but those who invent and grow move on and those who dont die out.

    unless they get a handout from guilty feeling winners.

    Dan, I understand what you're saying; and you can be certain I run the "take responsibility for your actions flag" up at least 10 times per day. But the case wasn't about whether or not she read a warning... it was about the lack of any warning. She couldn't have known how hot that coffee was prior to getting burned. Say I was a hateful person, I weld a piece of aluminum and tell one of the kids I help on their cars - "here, hold this". They'd get burned, and I, rightly, would get sued because there is no way other then a verbal warning to know whether or not aluminum is room temperature or 1200 degrees.

    The cereal case, if the warning is there is a sign which says "not good for you" or "you'll get fat eating this food" fantastic, however, if it says "this is good for you" and it's not, or "diet" and it has 1000 calories - they'd (by rights) be sued. I know it defies common sense that someone would do such hateful things; but from where I sit - people do hateful things as often as possible..... then claim they were framed when caught.
